These Terms of Use (“Terms”) govern your access to and use of six8creative.com, operated by SIX8 CREATIVE LLC (“Six8 Creative,” “Six8,” “we,” “us,” or “our”).

By accessing or using our website, you agree to these Terms.

These Terms govern the website. They do not replace any Master Services Agreement (“MSA”), Statement of Work (“SOW”), proposal, contract, license, release, or other agreement governing services provided by Six8.

1. Website Purpose

Six8 provides creative services that may include photography, videography, aerial/drone services, website design and development, social-media services, branding, and related creative work.

Our website provides general information about Six8, our services, previous work, and ways to contact us.

2. Website Inquiries Do Not Create a Contract

Submitting a contact form, requesting information, requesting a quote, discussing a project, or otherwise communicating with Six8 does not create a contract or obligate Six8 to accept or perform a project.

Projects may be subject to separate agreements establishing matters such as:

  • Scope;

  • Deliverables;

  • Pricing;

  • Deposits and payment;

  • Schedule;

  • Revisions;

  • Cancellation;

  • Intellectual-property rights;

  • Licensing;

  • Client responsibilities; and

  • Other project-specific terms.

Where a separate written agreement conflicts with these general website Terms regarding a project, the applicable project agreement controls.

3. Website Pricing and Packages

Six8 may display prices, packages, starting prices, examples, or other pricing information on the website.

Unless expressly stated otherwise, website pricing is provided for general informational purposes and does not constitute a binding quote or guarantee.

Pricing and packages may change.

Actual project pricing, scope, deliverables, and payment obligations are established through the applicable quote, proposal, SOW, MSA, invoice, or other agreement.

4. Payments

Payments for Six8 services may be processed through third-party platforms such as Xero, Stripe, Zenfolio, or other approved providers.

Those transactions may be subject to additional terms established by Six8 or the applicable provider.

5. Intellectual Property

Unless otherwise indicated, Six8 owns, licenses, or has permission to use the content displayed on six8creative.com.

This may include:

  • Photographs;

  • Video;

  • Graphics;

  • Designs;

  • Logos and branding;

  • Written content;

  • Website design elements;

  • Portfolio materials; and

  • Other creative works.

Website visitors may view this material for ordinary personal or business-evaluation purposes.

You may not copy, reproduce, download for commercial exploitation, modify, sell, license, redistribute, republish, or otherwise commercially use Six8-owned website content without authorization, except as permitted by applicable law.

Displaying client work in Six8's portfolio does not necessarily mean Six8 owns every underlying trademark, logo, product, or other element depicted in that work.

6. Client Intellectual Property

Clients and prospective clients may provide Six8 with logos, photographs, video, text, trademarks, music, graphics, documents, or other materials.

Providing material to Six8 in connection with a potential or active project does not automatically transfer ownership of that material to Six8.

Rights concerning client materials and finished project deliverables may be governed by the applicable client agreement.

7. Portfolio Content

Six8's website may contain examples of work created for previous clients.

Portfolio examples are intended to demonstrate Six8's capabilities and style. They do not guarantee that another project will achieve identical results, performance, engagement, sales, audience growth, or other outcomes.

8. Website and Marketing Results

Six8 does not guarantee that a website, social-media campaign, photograph, video, advertisement, branding project, or other creative service will produce a particular level of:

  • Website traffic;

  • Search-engine ranking;

  • Leads;

  • Sales;

  • Revenue;

  • Social-media engagement;

  • Followers;

  • Conversions; or

  • Other business results.

Any specific guarantees applicable to a project must be expressly stated in the applicable written agreement.

9. Website Development and Third-Party Platforms

Six8 may design or develop websites using third-party platforms and services.

References to platforms or technologies on our website do not imply ownership of or control over those third-party services.

Availability, features, pricing, policies, security, and functionality of third-party platforms may change independently of Six8.

Project-specific responsibilities concerning third-party services should be established in the applicable client agreement.

10. Drone Services

Six8 may advertise commercial aerial photography and videography services.

Commercial drone operations are subject to applicable laws, regulations, airspace restrictions, weather conditions, safety requirements, property permissions, and operational judgment.

Six8's availability to perform a requested drone operation is not guaranteed merely because drone services are advertised on the website.

Where required, commercial operations are conducted by or under the authority of an appropriately certificated FAA Part 107 Remote Pilot.

11. Testimonials and Examples

Testimonials, client comments, case studies, portfolio examples, or descriptions of previous projects reflect particular experiences and circumstances.

They do not guarantee that every client will receive identical results.

12. Acceptable Use

You may not use six8creative.com to:

  • Engage in unlawful or fraudulent activity;

  • Attempt unauthorized access to our systems;

  • Interfere with website security or operation;

  • Introduce malicious software;

  • Scrape or systematically extract website content without authorization;

  • Impersonate another person;

  • Infringe intellectual-property rights; or

  • Use Six8's name, branding, portfolio, or content in a misleading or unauthorized manner.

Six8 disclaims warranties concerning the website that may legally be disclaimed.

This provision concerns the public website. Warranties, commitments, and obligations concerning paid client services are governed by the applicable client agreement.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Six8 and its owners, employees, contractors, representatives, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or inability to use the public website.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

Liability concerning contracted client services is governed by the applicable client agreement and applicable law.

17. Privacy

Use of six8creative.com is also subject to our Privacy Policy.

Our website may use cookies and analytics technologies, and visitors may be provided controls for managing certain cookie preferences.

18. Changes to These Terms

Six8 may update these Terms from time to time.

When changes are made, we may revise the effective date shown above.

Changes to these general website Terms do not retroactively modify an existing client agreement where doing so would be inconsistent with that agreement or applicable law.

19. Governing Law

These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles, except where applicable law requires otherwise.

To the extent permitted by law, disputes arising specifically from these Terms or use of six8creative.com shall be brought in an appropriate court having jurisdiction in or over Monongalia County, West Virginia.

20. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
